As New Hampshire’s surrogacy resource, we can help you with all your legal needs for your surrogacy journey. We work with both intended parents and surrogates, and offer legal services tailored to your particular needs. Because Attorney Catherine Tucker is admitted to practice in both New Hampshire and Massachusetts, we can leverage the laws of both states to create an arrangement that is best suited to your particular situation.

General Information on New Hampshire Surrogacy

Both gestational and traditional surrogacy are permitted under New Hampshire law. Surrogacy is available for married couples (opposite sex as well as same-sex) and for certain unmarried couples and single persons. Parentage orders can be obtained using either pre-conception orders (similar to pre-birth orders), post-birth orders, or stepparent/second parent adoptions.  At the Law Office of Catherine Tucker, we will help you select the method of establishing parentage that best meets your particular circumstances, to allow you to have the smoothest surrogacy journey possible.

General Information on Massachusetts Surrogacy

While both gestational and traditional surrogacy are permitted under Massachusetts law, more legal protections are available when proceeding with a gestational carrier arrangement. Surrogacy is available for married couples (opposite sex as well as same-sex) as well as for unmarried couples and single persons. Parentage orders can be obtained using either pre-birth orders (for gestational carrier arrangements only), post-birth orders, or stepparent/second parent adoptions.  After assessing the circumstances of your particular arrangement, we will recommend the method of establishing parentage most appropriate for your situation.

Types of Surrogacy Arrangements We Handle

Compassionate Surrogacy

Compassionate surrogacy, sometimes called altruistic surrogacy, refers to an arrangement where the surrogate is not compensated for carrying the pregnancy. Compassionate surrogacy often involves arrangements between family or close friends. At the Law Office of Catherine Tucker, we have experience with compassionate surrogacy arrangements and can guide you through the process from start to finish, to ensure that all participants are protected throughout the journey.

Independent Surrogacy

Independent (“Indy”) surrogacy arrangements refer to matches that are made without the assistance of an agency. At the Law Office of Catherine Tucker, we can provide comprehensive legal services for your independent surrogacy journey, allowing you to have the peace of mind that comes with knowing that your rights are protected.

Traditional Surrogacy

Traditional surrogacy refers to an arrangement where the surrogate’s own egg is used. Traditional surrogacy is more affordable because it requires only artificial insemination, rather than in vitro fertilization. Traditional surrogacy arrangements are allowed in New Hampshire, and both intended parents’ names can go directly on the birth certificate provided that the pre-conception order process is utilized. By contrast, in Massachusetts, pre-birth orders cannot be obtained for traditional surrogacy arrangements.

Agency Matches

Some clients prefer to work with a surrogacy agency to help them locate a surrogate and to manage the process. For clients already working with an agency, we can handle the New Hampshire or Massachusetts legal work, including preparation or review of contracts and any necessary court process to obtain birth orders.
